TERMS & CONDITIONS

This page contains Terms and Conditions for all services provided by Capture with Sherrie/Sherrie Hurrell.

1. These terms and conditions will apply to the photographer and the client unless otherwise stipulated in writing by either the photographer or client and agreed on in writing by both the client and photographer.

2. Booking Deposit and Payment: The client shall pay a 50 dollar ($50) deposit upon booking any package except weddings. For a wedding package the deposit required will be $250. The booking is not confirmed until this deposit is paid. An invoice will then be emailed to the client The full amount will be paid before the commencement of the photoshoot. If this is not paid the photoshoot will not go ahead and the client will forfeit the booking deposit.

3. Cancellation: If the client cancels this Agreement more than six (6) calendar days before the photoshoot day, the booking deposit paid to the Photographer shall be refunded in full if the Photographer is able to re-book the same date. If the Photographer is NOT able to secure another client for the date, or if the cancellation occurs less than six (6) calendar days before the portrait date, the client forfeits the booking deposit.

4. Photographic Materials and Copyright: All photographic materials, such as original negatives, RAWS, and/or edited final photos shall be the exclusive property of the Photographer. The Photographer shall own the copyright of all images created and may use the work for samples, social media, contests, exhibition, advertising, website and self-promotion. Usage outside the bounds of this agreement will require the Client’s consent. If the client objects to this agreement, the photographer must be notified in writing before the photoshoot commences.

5. Client’s Usage: The Client is obtaining prints for personal use only, and shall not sell said prints or authorize any reproductions thereof by parties other than the Photographer.

6. Social Media: This applies to all social media, including but not limited to Facebook, Instagram and blogs. When the images created by the photographer are published online it is required that citation of photographer be made. The client agrees that they will under no circumstances alter any photographs that are placed in public on the internet. The client agrees to be responsible for any family member or friend who posts the photographs online and agrees that they are not to be altered in colour, or edited in any way with the exception of forced cropping to meet social media size requirements.

7. Failure to Perform: If the Photographer cannot perform this Agreement due to a natural disaster or other casualty, strike, or other cause beyond the control of the parties, or due to the Photographer’s illness, then the Photographer shall return any funds previously paid to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.

8. Delivery of Images: The final edited images will be delivered digitally within 4 weeks of the photoshoot. The RAW files will not be provided. The number of images provided will be stipulated in booking and the photographer is not required to provide any more images in excess of this number. All photos taken during the photoshoot will be kept for 6 months after the photography session. After this time the client files will be deleted and the photographer is not liable for any claims.

9. Liability: It is client’s responsibility to take care of themselves and their children; Capture with Sherrie is not responsible for any accident to any person/s or damage to public or private properties during the photoshoot.

10. Client accepts that all photographs will be taken and edited at the photographer’s discretion based on the photographer’s experience and artistic view.
